1. Introduction

This Flynx Privacy Policy outlines how Flynx (“Flynx”, “Company”, “we”, “our” or “us”) processes personal data collected from users of the Flynx App, as well as services delivered through the application and website (collectively referred to as the “Flynx Services”).

This Privacy Policy (“Policy”) is created to help you understand what information we gather, store, utilize and share. It applies whenever you browse our Website, open our App, or otherwise access and use our Services.

We strongly recommend you read this Policy carefully and ensure you fully understand and accept its terms. By using our Services, including our Website and App, you acknowledge your consent to this Policy. If you do not agree with any provisions within this Policy, please refrain from using our Services. Your continued use of the Services after we publish updates to this Policy constitutes your acceptance of those revisions.

2. What Types of Data We Collect?

We obtain data related to you through the methods described below while delivering Flynx Services. Please be aware that certain categories of information are necessary for us to provide Flynx Services to you.

We collect two main categories of data: personal information (“Personal Information”) and non-personal information. Personal Information refers to any data that can reasonably be used to identify you (such as your email address or full name). In contrast, Non-Personal Information means data that cannot be linked to an identified or identifiable natural person. Examples include aggregated usage statistics and technical data transmitted from your device, such as your device model, browser and operating system, language preference, access timestamps, and more. This section explains when and how we collect these forms of data.

2.1 Personal information

- Registration details: your date of birth, phone number (or email where applicable), password, user ID and preferred language;

- Profile content: your display name, profile photos, gender, place of origin, bio, linked social media profiles, educational background and occupation;

- User-generated content (“UGC”): comments, text messages, photos, images, videos, audio, code and other materials you upload, share or stream within the App while using Flynx Services;

- Facial data: collected when you use specific features to generate special visual effects or emojis for your livestreams or uploaded photos on Flynx Services. Such facial data is only processed locally offline to create these effects or emojis. We will not use it for other purposes unless we receive your explicit consent or convert it into de-identified data. We will never use your facial data for marketing or advertising campaigns, nor share this data with any third parties. Additionally, if you complete Real-Person Profile Picture Authentication, we collect your profile photo and facial recognition video for identity verification with your approval, by matching your profile image against the facial capture. This verification safeguards accounts against impersonation and fake profiles, and boosts the authenticity of Flynx Services. We do not store your facial recognition video on our servers; it is used solely for verification purposes.

- Payment-related information: full name, billing address, billing postal code, billing country, date of birth, purchase amount, payment method, credit or debit card numbers and other payment details required to complete transactions;

- Transaction records: transaction serial numbers and purchase history after you buy paid services;

- Social media data: information retrieved from third-party social platforms such as Facebook or Google, when you register a Flynx account via social login or connect your Flynx account to external social accounts;

- Government-issued identity documents. In certain scenarios, you may need to submit a copy of official ID to complete identity verification. This information is required to unlock some features of our Services.

- Device identifiers and device metadata. When you visit our Services, we collect your IP address, UDID, precise geolocation and other data sent from your device, including browser type and operating system details.

- Login history and usage analytics. To improve service functionality and deliver a better user experience, we collect technical data transmitted by your device during use, including records of your behaviour and interactions with our Services.

- Location information. The Company gathers your general geographic location (such as city and country). For instance, we may use your IP address to determine this approximate location. This data does not reveal your device’s exact physical position and is transmitted as standard internet traffic. We also collect inferred location signals, which help us deduce your potential interest in a location or that you may be situated there; this still does not pinpoint your device precisely. Furthermore, the Company may collect your device’s exact location (using GPS, device sensors, Wi-Fi access points, Bluetooth signals, beacon signals, cell tower identifiers and other geolocation sources) once you enable location services on your device (you must manually turn on location permissions).

- Correspondence information. When you email us or contact support through our in-service help channels, we collect the personal information you submit, such as your name, email address and any other details you choose to provide.

2.2 Non Personal Information

We may process, use and share non-personal information, aggregated datasets, or personal information rendered in non-human-readable formats (for example, anonymized aggregated statistics showing how our user base interacts with our Services). We use this data to operate and enhance our Services, compile aggregate metrics, carry out marketing activities, perform business and market analysis, and optimize your overall platform experience.

We can anonymize or de-identify information collected through our Services or other channels so the data can no longer identify you on its own. Our use and disclosure of such aggregated or de-identified data are not limited by this Policy, and we may share it with external parties for any purpose, including advertising and promotional activities.

If we combine Personal Information with anonymized data, the merged dataset will still be treated as Personal Information for as long as the data remains linked together.

3. How We Use Your Information?

We only process your Personal Information where permitted by applicable laws. Generally, we use your Personal Information for the purposes listed below:

- Service improvement: to refine and personalize our platform, roll out new features, deliver tailored content, recommendations and collect user feedback;

- Account management: to maintain registered user accounts, provide customer support, send account or subscription notifications, and notify you of updates to Flynx Services or other related products;

- User communications: to interact with you directly, for example by sending alerts about upcoming platform changes, promotional events or service upgrades;

- Content moderation: to review photos, images and user content posted or generated on Flynx Services, ensuring compliance with local content regulations across relevant jurisdictions;

- Content personalization: conduct research and analysis regarding your interests in content, products, advertisements and services available on Flynx Services, so we can develop and display customized content on our Website and App;

- Performance analytics: distinguish unique users, identify repeat visits from the same user, and track aggregate metrics such as total visitors, video view counts and demographic trends;

- Platform functionality and security: screen users who fail age requirements, diagnose and resolve technical faults, and detect, prevent and respond to suspected or confirmed fraud, unlawful conduct and intellectual property violations;

- Legal enforcement: enforce our terms of service and fulfill our legal obligations;

- Data aggregation: combine collected information for one or more of the purposes outlined above.

Cookies: We and our vendors and service providers deploy cookies and comparable tracking technologies (such as web beacons, flash cookies, etc.) (“Cookies”) to automatically gather data, measure and analyze which web pages you access and how you navigate the Platform, improve your browsing experience and refine our services. Cookies are small files placed onto your device that enable certain platform features. Web beacons are tiny embedded images or data snippets, also known as “pixel tags” or “clear GIFs”, capable of recognizing Cookies, recording page view timestamps, page descriptions and related device information. By using the Platform, you consent to our use of Cookies.

In addition, we may link your contact or subscriber information with your cross-device activity on our Platform using your email, login credentials or device identifiers. We are not responsible for the privacy practices of these third parties, and their data handling policies are not covered by this Privacy Policy.

You may decline or disable Cookies by adjusting your browser settings. Browser configuration steps vary by software; please refer to your browser’s official instructions. Note that some categories of Cookies may require extra steps to block. Also, your opt-out choice applies only to the browser or device you are using at the time, meaning you will need to opt out separately on each device and browser. If you reject, disable or delete Cookies, some functions of the Platform may become unavailable.

Please note that we may rely on multiple lawful bases to process your Personal Information, depending on the specific processing objective.

4. How We Share Data?

We do not rent, sell, or share your Personal Information with third-party recipients except as specified within this Privacy Policy. Personal Information will only be disclosed to these recipients to the extent necessary to fulfil the purposes described in this Policy.

We share Personal Information with the following categories of recipients:

- Service providers contracted to operate our Service;

- Our affiliated corporate entities;

- Subcontractors and third-party service providers, and their subcontractors, including (but not limited to) cloud service providers, marketing affiliates, anti-fraud services and identity verification vendors;

- Payment service providers and payment processors;

- Auditors, contractors, and legal, financial or other professional advisors supporting our business operations;

- Third parties tasked with investigating, detecting or preventing fraudulent or illegal conduct, or helping us enforce our policies, including verifying your funding sources (such as government authorities, law enforcement agencies, banks and investigative bodies);

- Government and regulatory authorities, in accordance with applicable laws and regulations;

- Prospective buyers, successors or investors within our group companies, or in the event of corporate transactions (such as sale of a substantial portion of our business, merger, reorganization, bankruptcy, consolidation, asset sale or operational transfer involving any group entity). In such cases, the acquiring entity or transferee will assume the rights and obligations laid out in this Policy.

5. International Data Transfers

We may transfer or disclose Personal Information to our subsidiaries, affiliates, subcontractors and other trusted third-party service providers or partners located in different countries worldwide, for the purposes stated in this Policy. Data collected by the Company may be stored and processed in any jurisdiction where the Company, its affiliates, subsidiaries, partners or service providers operate facilities.

When we share your information with these entities, we implement appropriate safeguards to ensure they protect your data in compliance with this Policy and applicable law.

6. Third party collection of information

This policy governs only the use and disclosure of data we collect directly from you. When you share your information with other parties through our Services or other websites across the internet, separate rules may apply to how those parties use and disclose your shared data. For example, when paying by credit card via our third-party processors such as Apple Store and Google Play Store, those providers may collect your card details and other data required to authorize and process payments. These payment providers may also send certain of your details back to us.

When you click a link leading to another website, mobile application or third-party content through Flynx Services, you will be redirected to an external platform controlled by a different entity, which may collect data about you. We have no oversight over, do not review, and accept no liability for these third-party websites, mobile applications or their content. Please understand that this privacy policy does not apply to these external platforms or any data collection occurring after you follow links to third-party content.

You knowingly and voluntarily bear all risks associated with using any Third-Party Services. You agree we will have no liability whatsoever related to your access and use of those Third-Party Services.

7. Children’s Privacy

Our Services are not intended for users below the Age of Consent (the age at which consent must be given or approved by a parent or legal guardian under local law in your place of residence). If you are under the Age of Consent, you may only use the Services with explicit permission from your parent or legal guardian.

If the Company discovers that Personal Information belonging to users below the Age of Consent has been collected through our Services without parental or guardian approval, we will take proper measures to delete that information, unless retention is required to satisfy statutory legal obligations.

If you are the parent or legal guardian of an underage registered user, please contact us at service@flynx.tv to request account termination and deletion of the child’s Personal Information.

8. What are Your Rights?

Data protection laws in certain jurisdictions grant specific rights to Flynx users, which are outlined in this section. Depending on applicable local legislation, you may hold some or all of the rights listed below. We will respond to your request as promptly as practicable, generally within one month after successful identity verification. Exercising these rights is normally free of charge, unless applicable laws permit us to impose a fee.

You can submit your request either (a) through the help or feedback tools within Flynx Services, or (b) by emailing us at service@flynx.tv.

- Access or delete Personal Information associated with you;

- Amend or update your Personal Information (for instance, if your records contain incorrect details, you may request correction or deletion). You may also ask us to fix errors in your Personal Information (except when applicable laws mandate preserving data in its original form);

- Request restriction on further processing of your Personal Information;

- Receive the Personal Information you provided to us in a machine-readable format;

- Object to the processing of your Personal Information (for example for marketing activities);

- Withdraw consent for processing activities that rely on your consent (where the processing is not based on another separate legal ground);

- Not be subject to decisions generated solely by automated processing, including profiling, that create legal consequences or similarly significant impacts for you, unless such processing is necessary to fulfil our contract with you, or authorized by your explicit consent as described in this Policy.

Please note these rights are not absolute, and all requests are subject to applicable legal requirements, including mandatory reporting and document retention duties. We may also correct, complete or remove incomplete or inaccurate information at our discretion, in line with our internal policies.

If you are dissatisfied with our response, you may submit a complaint to the relevant data protection supervisory authority.

9. Retention of Personal Information

We keep your Personal Information and other data for as long as your Flynx account remains active.

You may request account deletion at any time via Me > Settings > Account & Security > Delete Account inside the app. Once we review your request, we will erase data that we are not obligated to retain to meet regulatory, tax, insurance, litigation or other legal requirements.

All registered user account deletion requests will be handled within fourteen (14) days (the “Processing Period”). You may reactivate your account during this Processing Period. Once the Processing Period expires, you will no longer be able to log in, and the Company will remove all Personal Information linked to your account.

After you submit an account deletion request, we erase content you posted, streamed or created, and this data cannot be recovered afterwards. Information shared about you by other users is separate from your account and will not be deleted.

All account deletion requests are subject to our data retention policy, and the Company reserves the right to retain certain Personal Information to meet legal obligations, prevent fraud and maintain required records.

We may also retain selected information where necessary for platform safety, security and fraud prevention. For example, if we disable an account due to risky behaviour or security incidents, we may retain some account information to prevent that user from creating new Flynx accounts in future.

10. Changes and Updates to This Privacy Policy

We may revise or amend this privacy policy from time to time. While we will attempt to notify users of major revisions, you are expected to regularly review the latest version to stay informed of binding changes.

11. California Privacy Disclosure

This California Privacy disclosure supplements the Flynx Privacy Policy. These extra disclosures are required by the California Consumer Privacy Act. This section applies to California residents and information that identifies, relates to, describes, or may reasonably be linked directly or indirectly to California consumers (“California Information”).

11.1 Categories of Personal Information Collected

The personal information Flynx collects, or has collected from you within the twelve months before this disclosure’s effective date, falls into the categories below:

- Registration information, such as your date of birth, phone number (or email, if applicable), password, user identifier and language;

- Profile information, such as your alias, profile images, gender, hometown, self-introduction, social media information, education, and career;

- User-generated contents (“UGC”), such as comments, texts, messages, pictures, images, videos, sounds, code or other data or materials that you upload, distribute or stream on the App when you use Flynx Services;

- Payment information, such as full name, billing address, billing zip code, billing country, date of birth, purchase amount, payment method, credit or debit card number or other payment information where required for payment;

- Facial data, such as when you use some features provided by us to create special effects or emojis for your streaming section or pictures that you uploaded on Flynx Services, but such data will only be processed offline to fulfil the special effects or emojis and we will not use it for other purposes unless we have obtained your explicit consent or turn this into de-identified data; further, we will not use your facial data for marketing or advertising, nor will we share such data with any third party.

- Your location information, after you permit us to do so but you may change the access to your GPS information via the settings on your mobile device, and the information based on your SIM card;

- Information you provide, such as your opt-in choices and correspondence with us, and information you provide when you participate in in-app surveys and activities.

- Information you provide from social media when you create a Flynx account by connecting with a third-party social media;

- Network activity information, such as your browsing history, search history, the videos or pages you visited, the date and time of your visits, other users’ accounts that you subscribed to, and information regarding your interaction with other users;

- Information from Other Sources: We may obtain additional information from third parties and sources other than the Flynx Services. For example, we may obtain additional information from games or services you use, or social media networks (such as Facebook) for which you have approved our access. When you access the Flynx Services through social media networks or when you connect the Flynx Services to social media networks, you are authorizing Flynx to collect, store, and use such additional information and content in accordance with this Privacy Policy

- Device information, such as your operating system, browser type, brand, model and serial number of your mobile device, Internet Protocol (IP) address, mobile carrier, screen resolution, language setting, IMEI number, IMSI number, media access control address, and mobile advertising identifiers;

- Metadata associated with the UGC you provided us, which describes other data and provides information about how, when, and by whom the piece of UGC was collected and how that UGC was formatted, such as hashtags used to label the keywords to the video and captions;

- Cookies, small pieces of data to enable us to provide certain features, which are collected by us or our business partners to measure and understand the web pages you click on and how you use Flynx Services, enhance your experience using Flynx Services.

11.2 Categories of Personal Information Disclosed for a Business Purpose

The personal information that Flynx disclosed about you for a business purpose in the twelve months prior to the effective date of this Disclosure fall into the following categories:

Identifiers such as your IP address;

Personal information, such as your credit card number, email address, phone number and name, for example if we use a service provider to process payments;

Internet or other electronic network activity information, such as if we use a service provider to help us gather crash reports for analyzing the health of our services;

We disclose personal information to the following types of entities in the twelve months prior to the effective date of this Disclosure:

We may disclose your Personal Information to our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, analytics, facilitating your register or login, and supporting our functionality.

11.3 Your California Privacy Rights

Under the California Consumer Privacy Act, you may have rights to request details about Flynx’s collection of your personal information, or request access to or deletion of your personal information. If you wish to request information about the collection of your personal information, please send an email to us via service@flynx.tv. If you wish to delete your personal information, please send an email to us via service@flynx.tv.

Please note that certain data may be exempt from such requests under California law, and depending on your data preferences, some services may become limited or unavailable. No sale of personal information. Within the twelve months before this Disclosure’s effective date, Flynx has not sold any of your personal information, as defined under the California Consumer Privacy Act. No discrimination. Flynx will not discriminate against consumers who exercise their rights under the California Consumer Privacy Act.
